In Februray 2011, Dr Nyoka was ousted from his position at President of Cricket South Africa, by means of a vote of no confidence given at a Special General Meeting.

Dr Nyoka brought an Urgent Application to the South Gauteng High Court on the basis that his dismissal had been both procedurally and substantively unfair.

One of the main argument in this regard being that he was not afforded an opportunity to be heard at the February meeting, as he was not given proper notice in respect of the said meeting.

On the 14th of April 2011 Deputy Judge President Mojapelo of the South Gauteng High Court handed down judgment in the matter between Dr Mtutuzeli Nyoka and Cricket South Africa.

The Court found that Dr Nyoka’s dismissal had been unfair and ordered that he be re-instated with immediate effect.
